TINJAUAN HUKUM ATAS PRODUK PANGAN USAHA MIKRO KECIL DAN MENENGAH YANG TIDAK BERSERTIFIKAT HALAL

Abstract


ABSTRACT

A food product that is produced, packaged and traded in the territory Indonesia must be halal certified. The Output from the issuance of the halal certificate is the inclusion of halal label in the product that is in production in the form of packaging. As for information intended for the public to avoid eating food that is not halal (haram).The purpose of this study was to determine the responsibility of businesses to consumers for products of food UMKM and the responsibility of Food and Drug Supervisory Agency (BPOM) to the food products of UMKM are not certified halal. This research is a normative law research. Data collection methods used in this paper is the Method of Literature Research is done by reading, citing, noting, and understand the various books of literature, laws and regulations associated with the object being studied. And the type of data the research used the secondary data with primary legal materials, secondary legal materials and legal materials primary. The responsibility of businesses to consumers for products of food UMKM that produce halal food product by having the halal certification in providing convenience, safety, security, and certainty for the community in the consumption of food products of UMKM based on article 4 of Law Number 33 of 2014. And responsibilities of the BPOM over food products UMKM are not certified halal namely the withdrawal of the products circulating in the market, the granting of administrative penalties and confiscated without compensation with the function of supervision of pre- market evaluation and post market control through the method of supervision of both direct supervision and surveillance is not direct.
