Abstract


ABSTRACT

 

The debtor is declared in default not forever because the debtor does not carry out an obligation to the bank but it can also be caused by the debtor's delay in repaying his loan to the bank. Therefore, in channeling credit, a bank requires a guarantee as outlined in the form of an additional agreement, namely a guarantee agreement. Article 20 of Law Number 4 Year 1996 concerning Mortgage Rights stipulates that to execute Mortgage Rights it can be done in two ways, namely underhand sales if it benefits all parties and selling the object of the Mortgage by auction. With the execution of the Mortgage guarantee, the creditor will receive the credit loan repayment from the debtor.The research used in this research is an empirical legal research method by examining the applicable legal provisions and what happens in reality in society.The efforts of the Kisaran Branch of Bank Rakyat Indonesia to avoid executing collateral rights for bad debtors, namely in the form of peaceful settlement of bad loans by providing interest rate relief, selling collateral under hand, and extending the debtor's credit term; The obstacles in the efforts of the Kisaran Branch of Bank Rakyat Indonesia to avoid the execution of mortgage rights against bad debtors are that the bank provides too large a loan facility, the debtor runs away, the debtor and creditor elements commit collusion.
