PELAKSANAAN ISBAT NIKAH DI WILAYAH KOTA TANJUNGBALAI (STUDI DI PENGADILAN KOTA TANJUNGBALAI)

Abstract

This research discusses the settlement of the Iṡbᾱt Nikah case at the Tanjungbalai Religious Court. It cannot be denied that there are still problems in the community, especially in the City of Tanjungbalai, which does not register their marriage at the Office of Religious Affairs (KUA) due to certain reasons so there is no marriage certificate. To overcome this, the Tanjungbalai Religious Court accepted the Iṡbᾱt Nikah application for the community whose marriage was not registered as contained in Article 7 paragraph 2 of the KHI. This research is the result of empirical research to answer the following questions: 1). The basis for the Judge's legal considerations in giving Iṡbᾱt Nikah to the applicant; 2). Barriers to the Tanjungbalai City Religious Court in conducting the Iṡbᾱt Nikah trial;
